Terms & Conditions of Madofit
These Terms of Use (“Terms”), together with our Privacy Policy, Shipping Policy, Replacement, Returns and Cancellation Policy, and any other policies issued by Madofit (collectively, “Policies”), govern your access to and use of the Madofit platform, including our website, mobile apps, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms and Policies, which may be updated from time to time without prior notice. We recommend reviewing them periodically for changes.

1. General :
1.1 Acceptance :
By accessing or using the Platform, you agree to these Terms and Policies, whether or not you’ve read them. If you’re using the Platform on behalf of an entity, you confirm you’re authorized to do so.
1.2 Definitions :
“You” or “User” refers to any individual or entity (including their heirs or successors) using the Platform.
“Madofit,” “we,” “us,” or “Company” refers to Madofit Fitness Solutions Private Limited, its affiliates, subsidiaries, and personnel.
“Services” include browsing, purchasing products, and accessing support features on the Platform.
1.3 Non-Acceptance :
If you do not agree to these Terms, do not use the Platform.
1.4 Permitted Use :
You agree to use the Platform only for lawful purposes and in compliance with applicable laws and guidelines.
2. Services :
2.1 License :
We grant you a limited, non-exclusive, non-transferable, royalty-free license to use the Platform to access our Services, subject to these Terms.
2.2 Scope: Services include :
Browsing and purchasing fitness products (“Products”).
Accessing customer support for queries or grievances.
2.3 Modifications :
We may modify or discontinue Services at our discretion without notice.
3. Eligibility :
3.1 Requirements: To use the Platform, you must :
Be at least 18 years old (minors may use the Platform under guardian supervision).

Keep your login credentials confidential and notify us immediately of any unauthorized use at support@madofit.com. You’re liable for losses due to failure to secure your Account.
4.4 Termination: :
Breaching these Terms may lead to Account suspension or termination.
5. Pricing and Payments :
5.1 Accuracy :
We strive to provide accurate pricing, but errors may occur. If a Product is mispriced, we may contact you for instructions, adjust the price, or cancel the order before delivery.
5.2 Order Acceptance :
Orders are not confirmed until payment is processed and Products are dispatched. If we cancel an order after payment, we’ll refund the amount to your original payment method.
5.3 Payment Methods :
Payments can be made via credit/debit cards, net banking, EMI options, or other methods available on the Platform. You confirm that payment methods used are lawfully yours.
5.4 Security :
We use reasonable measures to secure payment information, but we’re not liable for fraud unless caused by our negligence.
5.5 Cash on Delivery (COD) :
If offered, COD applies to select Products and locations (not available internationally). Payment is due in cash upon delivery.
6. User Conduct and Content :
6.1 Prohibited Content :
You must not upload or share content that:
Infringes others’ rights (e.g., intellectual property, privacy).
Is obscene, defamatory, misleading, or unlawful.
Harms minors or threatens national security/public order.
6.2 Accuracy :
Providing false or incomplete information may lead to Account suspension or termination.
6.3 Liability :
You’re liable for damages caused by inaccurate information you provide. We’re not responsible for actions taken by others based on such information.
7. Platform Use :
7.1 Restrictions:
You may not : Copy, reproduce, or exploit Platform content for commercial purposes beyond personal use.
Interfere with Platform functionality or other Users’ enjoyment.
Attempt unauthorized access or introduce malicious code.
7.2 Content Removal :
We may remove or edit User Content that violates these Terms or is deemed inappropriate.
7.3 Third-Party Content :
We don’t control or endorse third-party products, services, or information displayed on the Platform unless explicitly stated.
8. Orders and Fulfillment :
8.1 Order Placement :
Orders are subject to payment confirmation and stock availability. We may accept or reject orders partially or fully.
8.2 Processing :
Non-COD orders are processed upon payment. If issues (e.g., incomplete address, stock unavailability) arise, our support team will contact you to resolve them before proceeding.
8.3 Order Confirmation :
An order number is generated upon successful payment or COD submission and sent to your registered email.
9. Shipping, Returns, and Cancellations :

10. Intellectual Property :
10.1 Ownership :
Madofit owns all intellectual property rights (e.g., trademarks, logos, content) related to the Platform and Products unless otherwise stated.
10.2 User Content License :
ou grant us a worldwide, perpetual, royalty-free license to use your User Content in connection with the Platform.
10.3 Respecting Rights :
Do not infringe others’ intellectual property. Report violations to ip@madofit.com. We may terminate access for repeat infringers.
11. Disclaimers and Liability :
11.1 As-Is Basis :
The Platform and Services are provided “as is” without warranties, express or implied, including merchantability or fitness for a particular purpose.
11.2 No Guarantees :
We don’t guarantee the Platform will be error-free, secure, or uninterrupted, or that Product information is accurate or complete.
11.3 Limitation of Liability :
To the fullest extent permitted by law, Madofit isn’t liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid for the Products ordered.
11.4 Product Disclaimer :
Products are sourced from trusted brands, but we don’t control their design, manufacturing, or labeling and aren’t liable for defects, claims, or adverse reactions. Product images and descriptions may vary slightly due to lighting or device settings.
12. Health Information :
12.1 General Guidance :
Health and fitness information on the Platform is for informational purposes only and not a substitute for professional medical advice. Consult a healthcare professional before using Products or starting fitness regimens.
12.2 No Liability :
We’re not responsible for injuries or damages from relying on Platform information or Product use.
13. Indemnity :
You agree to indemnify Madofit, its affiliates, and personnel against any claims, losses, or damages (including legal fees) arising from:
Your breach of these Terms.
Violation of laws or third-party rights.
Misuse of the Platform or Services.
This clause survives termination of these Terms.
14. Third-Party Links :
The Platform may link to third-party websites or services. We’re not responsible for their content, products, or practices. Use them at your own risk, subject to their terms and policies.
15. Privacy and Confidentiality :
15.1 Privacy Policy :
Your use of the Platform is governed by our Privacy Policy, detailing how we collect and use your information.
15.2 Confidentiality :
You must keep confidential any sensitive information (e.g., pricing, customer data) accessed via the Platform, except where disclosure is legally required.
16. Force Majeure :
We’re not liable for delays or failures to perform due to events beyond our control, including natural disasters, strikes, pandemics, or technical disruptions.
17. Termination :
17.1 By You :
You may terminate these Terms by closing your Account.
17.2 By Us :
We may terminate or suspend your access at any time without notice or liability.
17.3 Surviving Clauses :
Sections on disclaimers, liability, indemnity, intellectual property, privacy, and governing law survive termination.
17.4 Pending Obligations :
Termination doesn’t cancel your obligation to pay for ordered Products.
18. Governing Law and Dispute Resolution :
18.1 Law :
These Terms are governed by Indian law.
18.2 Arbitration :
Disputes will be resolved via arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed jointly by both parties. The venue is Mumbai, and proceedings are in English.
18.3 Jurisdiction :
If arbitration fails, disputes are subject to the exclusive jurisdiction of Mumbai courts.
18.4 Injunctions :
We may seek injunctive relief for breaches of intellectual property or confidentiality clauses.
19. Taxes :
Prices include applicable taxes (e.g., GST, VAT) unless stated otherwise. You’re responsible for any additional fees or taxes related to your purchases.
20. General Provisions :
20.1 Communications :
You consent to receive emails, SMS, or WhatsApp messages related to your Account or Services. Opt out via support@madofit.com .
20.2 Notices :
We’ll notify you via email or Platform announcements. Your notices to us must be sent to support@madofit.com with the subject “Attention: TERMS OF USE.”
20.3 Assignment:
You may not assign these Terms without our consent. We may assign them freely.
20.4 Severability :
If any provision is unenforceable, the rest remain in effect.
20.5 Waiver :
Our failure to enforce a provision isn’t a waiver of our rights.
